Weekend reading: The Defense Production Act

I was particularly interested in this article from Food Safety News: “What does the Defense Production Act have to do with food?”

This past week, FDA and USDA issued a Memorandum of Understanding Regarding the Potential Use of the Defense Production Act with Regard to FDA-Regulated Food During the COVID-19 Pandemic. The MOU refers to “potential use” because USDA has not yet invoked its DPA authority. Nor will it, in any likelihood. Messaging matters, however, and so the MOU may still operate to significantly influence the food system. What message does it send exactly?

Good question, and one well worth answering.  The author, Thomas Gremillion, has much to say about the topic, and compellingly.  He argues:

All of this is to say that the April 28 Executive Order is a paper tiger. But to the extent that the Administration sought to cow state and local public health officials, it may have succeeded. According to recent reporting, “As of May 19, nearly all of the once-closed meatpacking plants have started back up.” Large meatpackers have declined to disclose data on how many of their workers have fallen ill or died, but according to an analysis by Johns Hopkins University researchers, the rate of COVID-19 infections for counties with very large meatpacking plants was twice the rate in counties without for the week following the Trump executive order.

My latest publication: food and nutrition policy primer

How the US food system affects public health is a matter of intense current interest. “Food system” means the totality of processes through which food is produced, transported, sold, prepared, consumed, and wasted.4 Policies governing these processes emerged piecemeal over the past century in response to specific problems as they arose, with regulatory authority assigned to whatever agency seemed most appropriate at the time.5 Today, multiple federal agencies oversee food policies. For some policy areas, oversight is split among several agencies—the antithesis of a systems approach.

US food policies deal with eight distinct purposes, all of them directly relevant to public health:

  • Agricultural support: Overseen by the US Department of Agriculture (USDA), agricultural support polices are governed by farm bills passed every five years or so. These bills determine what crops are raised and grown, how sustainably, and the extent to which production methods contribute to pollution and greenhouse gas emissions.
  • Food assistance: The USDA also administers food assistance for low-income Americans through programs such as the Supplemental Nutrition Assistance Program (SNAP, formerly food stamps), the Women, Infants, and Children program, and school meals.
  • Nutrition education: This policy is set forth in dietary guidelines revised every five years since 1980 (overseen jointly by the USDA and the US Department of Health and Human Services) and in the MyPlate food guide (USDA).
  • Food and nutrition research: The National Institutes of Health and the USDA fund studies of diet and disease risk.
  • Nutrition monitoring: The USDA and the Centers for Disease Control and Prevention are responsible for keeping track of the quantity and quality of the foods we eat and how diet affects our health.
  • Food product regulation: Rules about food labels, health claims, and product contents are overseen by three agencies: the USDA for meat and poultry; the Food and Drug Administration (FDA) for other foods, beverages, and dietary supplements; and the Federal Trade Commission for advertising.
  • Food safety: Regulation of food safety is split between the USDA for meat and poultry and the FDA for other foods.
  • Food trade: More than 20 federal agencies are involved in regulating the export and import of food commodities and products, among them are the FDA, the USDA, and the Department of Homeland Security.

This list alone explains why advocates call for a coordinated national food policy.6

The food policy primers in this issue of AJPH address the critical links between agricultural policies and health (Miller et al., p. 986) and key components of food assistance policies: direct food aid to the poor (Brownell et al., p. 988) and nutrition standards for school food (Schwartz et al., p. 989). Their authors are well-established policy experts whose thoughtful comments on the political opposition these programs face make it clear why food system approaches to addressing hunger, obesity, and climate change are essential.

Politics stands in the way of rational policy development, as the editorial by Franckle et al. (p. 992) suggests. Although its authors found substantial bipartisan support for introducing incentives to improve the nutritional quality of foods purchased by SNAP participants, congressional interest in this program remains focused almost entirely on reducing enrollments and costs. Please note that for a special issue of AJPH next year, I am guest editing a series of articles on SNAP that will provide deeper analyses of that program’s history, achievements, needs for improvement, and politics. Stay tuned.

In the meantime, how can US public health advocates achieve a systems approach to oversight of the eight food and nutrition policy areas? A recent report in the Lancet suggests a roadmap for action. It urges adoption of “triple-duty” policies that address hunger, obesity, and the effects of agricultural production on climate change simultaneously.7 For example, a largely—but not necessarily exclusively—plant-based diet serves all three purposes, and all federal food policies and programs, including SNAP, should support it. The primers and editorial should get us thinking about how to advocate a range of food system policies that do a better job of promoting public health. Read on.

The sad state of the US dairy industry: sensible policies needed

The New York Times writes about the tragedy of Wisconsin dairy farms.

Over the past two years, nearly 1,200 of the state’s dairy farms have stopped milking cows and so far this year, another 212 have disappeared, with many shifting production to beef or vegetables. The total number of herds in Wisconsin is now below 8,000 — about half as many as 15 years ago. In 2018, 49 Wisconsin farms filed for bankruptcy — the highest of any state in the country, according to the American Farm Bureau Federation.

It explains this as the result of “The rise of corporate farms and more efficient milking processes have led to an oversupply as consumption of milk has waned nationally.”

What’s going on with dairy farming is astonishingly poor policy, especially for small farmers who are now a deeply endangered species.

How to explain?  Bad policy.

In what other industry would you find producers continuing to ramp up production while demand slides, and then stuffing the growing pile of surplus into warehouses, hoping the federal government will buy some of it?

The result: The government is now stockpiling 1.4 billion pounds of cheese.

Should dairy farmers go back to a system of restricting production the way they do in Canada?

One thing is for sure.  If we want local dairy farms to survive, we have to find a way to pay dairy farmers as much or more than it costs them to produce.

Serious policy thinking, anyone?

Weekend reading: Farming While Black

Leah Penniman.  Farming While Black: Soul Fire Farm’s Practical Guide to Liberation on the Land  Chelsea Green, 2018.

This is the second copy of this book sent by the publisher.  The first was snapped up off my desk by a colleague who was desperate for this book, not even knowing it existed.

For good reason.

This book is way more than a how-to guide, although it does that part splendidly.  It thoroughly integrates farming basics with necessary elements of supportive community, grounded in Penniman’s experience with Soul Fire Farm near Albany, New York.

Every section emphasizes the importance of community.

  • On finding the right land: make sure it is geographically accessible to a community where you feel you can belong.
  • On mission statements: train and empower aspiring Black, Latinx and indigenous growers; advance healing justice.

Every section emphasizes resources for Black farmers—scholarships, training programs, university programs, food hubs—and the contributions of traditional African and modern African-American farmers to what we know about how best to conduct sustainable agriculture.

The book is firmly grounded in history.  I particularly appreciated the annotated timeline of the trauma inflicted on Black farmers induced by racism.  This history begins with slavery, but continues through police brutality, convict leasing, sharecropping, Jim Crow laws, land theft, USDA discrimination, real estate redlining, and today’s mass incarceration and gaps in income, food access, and power.

Karen Washington wrote the Foreword:

We sat with pride as we went around the circle introducing ourselves, talking about our frustrations with not being represented at food and farming conferences.  I sat in awe as this young Black woman [Penniman] engaged us in conversation about race and power…this masterpiece of indigenous sovereignty [Farming While Black] sheds light on the richness of Black culture permeating throughout agriculture.

From Penniman’s chapter on keeping seeds:

Just 60 years ago, seeds were largely stewarded by small farmers and public-sector plant breeders.  Today, the proprietary seed market accounts for 82 percent of the seed supply globally, with Monsanto and DuPont owning the largest shares…Beyond simply preserving the genetic heritage of the seed it is also crucial to our survival that we preserve the stories of our seeds…our obligation is to keep the stories of the farmers who curated the seeds alive along with the plant itself.    It matters to know that roselle is from Senegal and tht the Geechee red pea is an essential ingredient in the Gullah dish known as Hoppin’ John.  In keeping the stories of our seeds alive, we keep the craft of our ancestors alive in our hearts.

Penniman offers suggestions for white readers who might want to help:

Adopting a listener’s framework is the first step for white people who want to form interracial alliances  Rather than trying to “outreach” to people of color and convince them to join your initiative, find out about existing community work that is led by people directly impacted by racism and see how you can engage.

This is an important book for everyone who cares about farming and agrarian values, regardless of color.

Trump’s $12 billion “gold crutches” to deal with trade retaliation against US agriculture

President Trump says he will fix the retaliation damage his trade policy has caused for agriculture with $12 billion added to USDA programs.

The New York Times quote of the day:  “This trade war is cutting the legs out from under farmers and the White House’s “plan” is to spend $12 billion on gold crutches.”  –Sen. Ben Sasse, R-Nebraska

The USDA explains that

These programs will assist agricultural producers to meet the costs of disrupted markets. This is a short-term solution to allow President Trump time to work on long-term trade deals to benefit agriculture and the entire U.S. economy.

Politico (behind paywall) quotes USDA Secretary Perdue: “”The programs we are announcing today are a firm statement that other nations cannot bully our agricultural producers to force the United States to cave in.”  It explains that the 3-part plan will:

  1. Provide direct payments to growers and producers of soybeans, sorghum, corn, wheat, cotton, pork and dairy.
  2. Purchase fruit, nuts, rice, beef, pork and dairy products from U.S. producers for redistribution to federal nutrition assistance programs.
  3. Put resources toward finding new markets for U.S. farmers to sell their products abroad.

Not everyone loves this idea.  Politico quotes Senator Ron Johnson (R-Wisconsin):

This is becoming more and more like a Soviet-type of economy here: Commissars deciding who’s going to be granted waivers, commissars in the administration figuring out how they’re going to sprinkle around benefits…I’m very exasperated. This is serious.

It also quotes Rep. Dave Reichert (R-Wash.) observing that the bailout does nothing to preserve market access lost as a result of the tariff policies.

Some in the ag community, they say, ‘That’s great, thank you for the help’ — except that the problem then becomes we’ve lost the market, so how do we get the market back?…That’s the question.

In general, agricultural groups view this as an inadequate short-term fix for a problem that won’t go away until Trump ends the trade war.

Former USDA Secretary Dan Glickman tweeted a link to a longer statement:

Rep. Chellie Pingree (D-Maine) is introducing legislation to ensure a fairer distribution of the bailouts.  How about some trade relief for fishermen?

In the meantime, The Street reports the effect of this plan on the market: Soybean futures for November delivery settled more than 1% higher; Deere & Co. and other farm equipment stocks also went up.  CBS News also notes the rise in ag stock prices.

Analysts generally view this as a move to maintain Trump’s base of support among soy and corn producers in the lead up to the midterm elections.  It solves a short-term political problem, but does nothing to protect US agricultural markets.  See, for example, accounts from

Pork Barrel Politics: Trade and Other Issues

Pork.  I love the term.  It reeks of politics.

Pork’s Trade Problem

I’ve been following the pork industry’s problem with the Trump Administration’s trade policies with much interest.

We imposed tariffs on steel and other such things.  Countries are retaliating by imposing their own tariffs—with pork high on the list.

Japan, China, and Mexico are our biggest markets for pork.  Oops.  They are now looking to Europe as the source.

The USDA’s livestock, dairy and poultry outlook report predicts a big drop in hog prices.

Pork’s With-Friends-Like-These Problem

And then there’s IRep. Steve King (R-Iowa).  In a Breitbart News radio interview, he says he doesn’t want Somalis working in meat-packing plants: “I don’t want people doing my pork that won’t eat it, let alone hope I go to hell for eating pork chops,” he concluded.

This follows a tweet he sent recently.

I suspect there are less confrontational and more effective ways to defend his home-state’s industry.  I wish them luck.

Pork’s Price-Fixing Problem

A lawsuit alleges that Hormel and other pork companies colluded to raise pork prices.  It was the lawsuit filed last week that attracted plenty of headlines.  They did this using Agri Stats, an information system accused of rigging the poultry industry.

Hormel Foods issued a statement denying the allegations:

Hormel Foods is a 127-year-old global branded food company with a reputation as one of the most respected companies in the food industry…We are confident that any allegations such as these are completely without merit. We intend to vigorously defend this lawsuit.

Pork’s Environmental Legal Problem

The courts are beginning to rule against Big Pork in cases where communities are complaining about odor and environmental contamination.  Smithfield, now owned by China, just lost a case.

Expect more such cases to follow.

Trump’s government reorganization plan: really?

The Trump Administration announced its new plan to reorganize government.  Obviously, this affects the agencies dealing with agriculture, food, and nutrition issues—USDA, FDA, and FDA’s parent agency, HHS.  Here is my translation of the major shifts being proposed:

  • Move most of USDA’s nutrition programs—SNAP, WIC, the Child and Adult Care Food Program, and the Farmers’ Market Nutrition Program—to HHS.
  • Move FDA’s food safety oversight to USDA, putting USDA in charge of all food safety.
  • Downsize the Public Health Service Commissioned Corps.

Congress would have to vote on all this so there’s no point in going too deeply into the weeds at this point, but I have just a few comments:

  • Putting all food safety oversight in one agency is a good idea, but not if it’s USDA.  USDA’s principal purpose to to support agribusiness.  Holding agribusiness responsible for food safety puts USDA in conflict of interest.
  • Moving SNAP and WIC into HHS (or whatever its new name will be) would make sense if HHS weren’t already overwhelmed by everything else it has to deal with (more than a trillion dollars in spending).
  • The proposal still leaves school breakfasts and lunches and commodity programs in USDA, meaning that food assistance programs will still be split between USDA and HHS.
  • Downsizing the Commissioned Corps doesn’t make much sense either.  Public health needs all the health it can get.

Whatever happens with this is unlikely to happen quickly.  USDA will not be happy about losing SNAP’s $80 billion a year or WIC’s $6 billion budget.

Many other agencies are also affected by these proposals.  My prediction: Congress will have a lot of trouble coming to agreement on these ideas.

Maybe this is just another attempt to distract us from more pressing matters.

Law Professor Timothy Lytton, an expert on food regulatory policy, has plenty to say about why moving food safety to USDA won’t work (in my paraphrasing):

  • Congressional committees are unlikely to support any reorganization that would reduce their power.
  • Industry associations are unlikely to support a reorganization that would disrupt their influence with existing agencies.
  • The two agencies are different in jurisdiction, powers and expertise; a merger would require a complete overhaul of federal food safety laws and regulations, a task of extraordinary legal and political complexity.
  • A merger might create new forms of fragmentation.
  • Reorganization is expensive and will take years.  The payoff is unclear.

As I’ve explained before, plans for a single food safety agency have been in the works for years, but have encountered many barriers.  The Food Safety Modernization Act was meant to be step #1 in a three-step process:

  1. Pass and implement rules governing FDA’s oversight of pretty much all foods except meat and poultry (this is now done).
  2. Fix USDA’s food safety rules governing meat and poultry so they are consistent with FDA’s (in the talking stage, hopefully).
  3. Merge the food safety responsibilities in one agency.

These proposals, alas, ignore step #2.  Good luck with that.

Food recalls increasing: Is this good or bad news?

Do food recalls reflect failures in food safety regulation or should they be considered a success?

USDA reports a significant increase in recent food product recalls.

  • Between 2004 and 2008, food recalls averaged 304 a year
  • Between 2009 and 2013, they averaged 676 a year.

USDA attributes the increase to

  • Improvements in pathogen and risk-detection technology
  • Increased regulatory oversight and enforcement
  • Congressional passage of food safety legislation

This sounds like success, no?

The food categories accounting for most recalls?

  • Prepared foods and meals
  • Nuts and seeds
  • Baked goods and grains
  • Candy
  • Sauces, condiments and dressings

The most common reasons for the recalls:

  • Failure to declare major allergens
  • Possible Salmonella contamination.

Here’s another reason, according to a new report from the Government Accountability Office: USDA’s inadequate standards for pathogens in meat and poultry, particularly turkey breasts and pork chops.

The report recommends that USDA work on this problem.  The USDA says it will.

Food safety requires endless vigilence, and government agencies need to do vigilent oversight.
