Seafood politics: Catfish? Really?

The Senate just voted to reverse a decision of Congress last year to remove catfish inspection from the FDA (which is usually in charge of regulating seafood) and give it to the USDA (which usually regulates meat and poultry).

Why did the 2008 and 2012 farm bills say that catfish inspection should be given to USDA?

It depends on whom you ask.

  • Defenders say it’s because USDA has the resources to protect us against unsafe Vietnamese catfish.
  • Critics said it’s to protect the Mississippi catfish industry against the food safety hazards of cheap imported catfish from Vietnam.

Indeed, the USDA inspection program is finding antibiotics and other unapproved carcinogens in catfish imported from Vietnam.

This issue, however, is a sticking point in US negotiations with Vietnam over the Trans Pacific Partnership trade agreement.

Vietnam wants the USDA catfish inspection removed as an unfair barrier to trade.

As I wrote about this issue in 2013,

What is this about?  Not fish safety, really.  It’s about protecting catfish farmers in the South and setting up “more rigorous” safety criteria that will exclude competitive foreign catfish imports, especially from Vietnam.

Food retailers and retail trade associations are for reverting inspection to FDA. They say USDA’s catfish inspection program will take years to allow imports from Vietnam, thereby causing the cost of domestic catfish to rise.

But today, Politico Morning Agriculture reports that more than 100 House Republicans are urging repeal of the USDA’s catfish inspection program, pointing out that

The Government Accountability Office (GAO) has 10 times stated that this program is “duplicative” and at “high risk” for fraud, waste, abuse, and mismanagement…This is not a food safety issue.  USDA acknowledges that catfish, regardless of where it comes from, is considered a “low risk food.”

When I wrote this issue previously, I got comments that I needed to better appreciate the superiority of USDA’s import safety program.  As I said in response:

It’s not surprising if USDA’s import safety system is better than the FDA’s.  USDA gets $14 million a year to run its currently non-operating catfish inspection system.  The FDA gets $700,000 and, according to the Government Accountability Office, has managed pretty well with it.

My conclusion then and now:

If the political fuss over catfish inspection reveals anything, it is why we so badly need a single food safety agency—one that combines and integrates the food safety functions of USDA and FDA—to ensure the safety of the American food supply.

The Senate’s (mostly unfunded) agenda for the FDA

Food Chemical News reports that the Senate Appropriations bill comes with report language instructing the FDA to:

  • Conduct a risk assessment to see how harmful it really is to eat Listeria-tainted frozen vegetables [these, presumably, would be cooked before eating].  CRF Frozen Foods had to recall of 358 organic products after 7 people became ill.
  • Release no sodium guidelines before the National Academies of Science has a chance to update the Daily Reference Intake (DRI) for sodium [which will take years].  The report says “it is “imperative that any guidance be issued using the latest sound science…based upon an updated DRI report.”  House directives said the same thing.  [The FDA has just released voluntary sodium guidelines for public comment].
  • Release its overdue report on food traceability systems: “The Committee directs the FDA to collaborate with science-based international and industry-led food traceability initiatives of the type recommended by the pilot projects…[and] to make publicly available information on FDA’s efforts to encourage…traceability initiatives.”
  • Reconsider its E. coli standard.  The Senate views this standard as too stringent and disruptive of raw milk cheese businesses.
  • Actively engage stakeholders in best practice standards for medical foods. “They should work together on “forming a framework for a distinct regulatory pathway for medical foods that does not encumber its progress towards approval for patient use.”
  • Better enforce standards for antibiotics in shrimp imports.
  • Sample olive oil bottles at retail to determine if they are adulterated, and report findings to Congress.
  • Report on efforts to implement regulations for the growing commercial human milk industry.

Some of these directives would improve food safety, but some would not.

All make more work for the FDA.

Does the Senate also plan to appropriate sufficient funds for the FDA to do all this in addition to what it is already doing?  Want to take bets?

Bacteria in ground beef dangerous or natural? Depends on point of view, apparently.

Consumer Reports has just done a major report on the safety of ground beef.

In its announcement of the report, Consumer Reports says:

All 458 pounds of beef we examined contained bacteria that signified fecal contamination (enterococcus and/or nontoxin-producing E. coli)…Almost 20 percent contained C. perfringens, a bacteria that causes almost 1 million cases of food poisoning annually. Ten percent of the samples had a strain of S. aureus bacteria that can produce a toxin that can make you sick…One of the most significant findings of our research is that beef from conventionally raised cows was more likely to have bacteria overall, as well as bacteria that are resistant to antibiotics, than beef from sustainably raised cows.

For public health people, results like this should send alarm signals.  The presence of E. coli, even the non-toxic type, indicates fecal contamination.  This is more than a yuck problem.  If E. coli is there, dangerous fecal pathogens could be there too.

But the North American Meat Institute headlined its response: “Consumer Reports Ground Beef Study Confirms Strong Safety of Ground Beef.”

The “bacteria identified in the Consumer Reports testing are types that rarely cause foodborne illness. Bacteria such as Staphylococcus aureus, Enterococcus, and generic E. coli are commonly found in the environment and are not considered pathogenic bacteria…Bacteria occur naturally on all raw food products from beef to blueberries so finding certain types on some foods in a grocery store is not surprising and should not be concerning,”

For the meat industry, fecal contamination is normal, natural, and you don’t need to worry about it—just be sure to cook your meat to a temperature high enough to kill all pathogens.

Good luck with that.

My advice: if you like ground beef rare, go to a butcher shop and ask to have one piece of meat ground for you in a freshly cleaned grinder.

Is the food movement winning?

Brian Lehrer asked me a question this morning that is well worth pondering.

The gist: Are the recent actions taken by food companies an indication that consumers are having an effect at the expense of science—and at the expense of focusing on more important food issues such as too much sugar, obesity, and diabetes?

He cited these recent events:

  • Tyson’s says it will phase out human antibiotics in broiler production.
  • McDonald’s says it will source chicken that has not been treated with antibiotics.
  • PepsiCo says it is taking aspartame out of its diet sodas (it’s the #1 reason given for not drinking diet cola).
  • Chipotle says it will source GMO-free ingredients.
  • Nestlé says it is removing artificial colors from its chocolate candy.
  • Kraft says it is taking the yellow dyes out of its Mac n’ Cheese.

To all of them, I say it’s about time.

None of these is necessary in the food supply.

There are plenty of scientific questions about all of them, although some—antibiotics, for example—are more troubling than others.

If voting with your fork can achieve these results, they pave the way for taking on the much more difficult issues.

These are big steps forward.  They matter.

They should inspire other companies to do the same.

The Paleo diet, sigh

The Wall Street Journal, hoping to generate some controversy, got me involved in a point/counterpoint about the Paleo Diet: “Is a Paleo diet healthy?”

It can be, but this is a point/counterpoint.  Hence, I took the position “NO: You Lose Too Much Pleasure for Dubious Benefits.”  

Here’s what I said:

Nutritionist that I am, the first questions I have about any diet are: What is it? Is the rationale behind it logical? And does it promote health?

A paleo diet is based on the premise that our genes govern what’s best for us to eat. We evolved to eat whatever could be hunted or gathered. This makes it OK to eat leaves, shoots, roots, seeds, eggs, animals, birds and fish, but not OK to eat grains, legumes, dairy or processed foods.

Why do paleo proponents think the ills of modern society stem from a mismatch between our genetics and today’s typical diets? The cave men, some argue, didn’t suffer from diseases such as obesity, heart disease and diabetes.

The problem with that theory is that we really don’t know what our Paleolithic ancestors ate. As I often argue, determining what people eat is the single most intellectually challenging question in nutrition science. It is extraordinarily difficult to get an accurate idea of what people ate yesterday, let alone 10,000 to a million or more years ago.

In reality, scientists are nowhere near being able to match genes to specific kinds of diets. The reason cave men didn’t have chronic diseases like diabetes is more likely because they didn’t live long enough and lacked antibiotics, rather than because they didn’t eat carbohydrates.

Variety is key

What we know for sure is that the fundamental tenets of nutrition are variety, balance and moderation. The fewer kinds of foods consumed, the greater the chance of nutrient deficiencies. So while it is certainly possible to eat healthfully on a paleo diet, restricting whole groups of relatively unprocessed foods can make this more challenging. It also can take some of the joy out of eating by forcing people to give up foods that they love or that are part of their cultural heritage.

While there is no doubt that highly processed “junk” foods are unhealthy and should be kept to a minimum, grains and legumes are hardly the enemy. Diets that vary enormously—from the traditional high carbohydrate, rice-based cuisines of Asia to those of the Mediterranean rich in grains and olive oil—have been shown to promote health and longevity.

Yes, grains contain glutens, and bread and pasta are caloric, but such foods are also delicious and part of traditional diets in nearly every culture. Yes, legumes contain unpleasant phytochemicals, but these are mostly destroyed by cooking, and beans and peas are excellent sources of vegetable protein. If you eat foods from animal sources, why restrict dairy? Cheese and yogurt are lovely foods, and I, for one, cannot imagine life without an occasional serving of ice cream.

Eating less works

Any restrictive diet helps to reduce calorie intake, so it isn’t surprising that there are studies linking paleo to weight loss, lower blood sugar and a reduced risk of cancers for which obesity is a risk factor. Eating less works every time.

So does eating a largely plant-based diet. Research suggests that we can reduce risks for today’s diseases of affluence by eating more foods from plant sources and balancing calorie intake with expenditure. To the extent the paleo diet achieves these goals, it is a reasonable choice.

But food is so much more than bundles of nutrients. What we eat also nourishes us psychologically and culturally. So while a paleo diet isn’t necessarily bad, why bother? I’d be sad to miss all those delicious forbidden foods.

Conflicts of interest in nutrition research: recent examples

I’ve been collecting examples of conflicted research for the past week or so.  These are studies paid for in part by food businesses or trade associations with a vested financial interest in the outcome of the research.

These almost invariably promote the financial interests of the sponsor.  To wit:

Cocoa flavanol consumption improves cognitive function, blood pressure control, and metabolic profile in elderly subjects: the Cocoa, Cognition, and Aging (CoCoA) Study—a randomized controlled trialby Daniela Mastroiacovo, Catherine Kwik-Uribe, Davide Grassi, Stefano Necozione, Angelo Raffaele, Luana Pistacchio, Roberta Righetti, Raffaella Bocale, Maria Carmela Lechiara, Carmine Marini, Claudio Ferri, and Giovambattista Desideri.  Am J Clin Nutr 2015; 101:538-548 doi:10.3945/ajcn.114.092189.

Dairy consumption and risk of cardiovascular disease: an updated meta-analysis of prospective cohort studies, by Li-Qiang Qin PhD, Jia-Ying Xu PhD, Shu-Fen Han PhD, Zeng-Li Zhang PhD, You-You Zhao PhD, Ignatius MY Szeto PhD.   Asia Pac J Clin Nutr. 2015 Mar;24(1):90-100. doi: 10.6133/apjcn.2015.24.1.09.

  • Conclusion This meta-analysis provided further evidence supporting the beneficial effect of dairy consumption on CVD. Low-fat dairy products and cheese may protect against stroke or CHD incidence.
  • Sponsor: Nestec Ltd. (Nestlé R&D (China) Ltd.  Two of the authors work for the company (to which I am not related).

In each of these cases, the sponsors got what they paid for.  Recent sponsored studies have not come to conclusions contrary to the interests of the sponsor.

Coincidence?

USDA’s new poultry inspection system, complicated but voluntary

I thought it might be time for a summary of why USDA’s new requirements for poultry inspection are so controversial.  Some groups think they are a big step forward; others most definitely do not.

The USDA says its new rules, which are largely based on research published in 2011:

  • Will place new requirements on the poultry industry.
  • Will prevent 5000 illnesses a year from Salmonella and Campylobacter
  • Puts trained USDA inspectors where they will do the most good.
  • Require poultry facilities to test for Salmonella and Campylobacter at two points during production (USDA will continue to do its own testing).
  • Giving poultry producers the option of doing their own inspections.
  • Caps the maximum line speed at 140 birds per minute (rather than the 175 the industry wanted).
  • Estimates the public health benefit at $79 million.

It also says

More inspectors will now be available to more frequently remove birds from the evisceration line for close food safety examinations, take samples for testing, check plant sanitation, verify compliance with food safety plans, observe live birds for signs of disease or mistreatment, and ensuring plants are meeting all applicable regulations.

The main issues

Line speed:  this refers to the evisceration line and is the speed at which workers must deal with the chickens.  The current speed is 140 birds per minute.  This means 2.33 birds per second.   It’s hard to imagine that any worker could manage that—or any inspector could see anything—at that speed.

The National Council of La Raza wrote USDA  in 2012 that raising the line speed posed a hazard to worker safety and “would recklessly threaten the health and safety of poultry workers.”  USDA listened.  The NCLR must be pleased.

The poultry industry is not pleased.  The National Chicken Council complains that “politics have trumped sound science, 15 years of food and worker safety data and a successful pilot program with plants operating at 175 birds per minute.”

Politico ProAg points out that the new system will cost the poultry industry $259 million—what it would have gained if line speeds increased to 175 per minute.

Privatization of inspectors.  The new rules shift responsibility for inspecting chickens, no matter how impossible, to company employees—the fox guarding the chickens, as it were. Food and Water Watch argues that this poses a conflict of interest since it’s in the managers’ interest to keep the lines moving as fast as possible and not to find anything wrong.   Food and Water Watch says the new system “will transfer most poultry inspection from government inspectors to the companies so they can police themselves.” Several members of Congress have also complained.   The Government Accountability Office (GAO) issued a report noting that USDA doesn’t really have data on which to base this change.

Change in function of USDA inspectors.  Up to 1,500 USDA phased out of poultry production may have to relocate or retire.  USDA estimates it will save $90 million over the next three years from this reduction.

Turkeys.  The new system allows turkey plants to raise line speeds to 55 per minute, up from 51 birds per minute.  The National Turkey Federation says most turkey plants will comply.

Waivers.  The Washington Post says the new system “provides a waiver to 20 plants that are already in a pilot program, letting them operate at 175 birds per minute.”

Voluntary.  The program is voluntary.  Plants can continue doing things the way they are.  

What to make of all this?  The testing requirements are a huge step forward.  The inspection changes seem mixed. It’s hard to believe that line inspection is useful even at 140 birds per minute.  

I’d rather have USDA inspectors making sure prevention controls are in place and adhered to, the testing is done honestly, and keeping an eye out for unsafe worker conditions (which, alas, is not their job).  

Let’s give it a try and see how it works in practice.

Salmonella is not an adulterant, says USDA.  If it were, anything contaminated with it could not be sold.  USDA denied the petition from Center for Science in the Public Interest to have four antibiotic-resistant strains of salmonella declared as as adulterants in ground meat and poultry products.

After thoroughly reviewing the available data, FSIS has concluded that the data does not support giving the four strains of [antibiotic-resistant] salmonella identified in the petition a different status as an adulterant in raw ground meat and raw ground poultry than salmonella strains susceptible to antibiotics.

The Foster Farms Salmonella outbreak is over, says the CDC.

The CDC announced today a total of 634 persons infected with seven outbreak strains of Salmonella Heidelberg were reported from 29 states and Puerto Rico from March 1, 2013 to July 11, 2014.

Epidemiologic, laboratory, and traceback investigations conducted by local, state, and federal officials indicated that consumption of Foster Farms brand chicken was the source of this outbreak of Salmonella Heidelberg infections.

38% of ill persons were hospitalized, but no deaths were reported.

Most ill persons (77%) were reported from California, but cases were reported in other states as well.

And that’s why all of this matters so much.

A Roundup (no pun intended) on organics

It’s been a busy couple of weeks on the organic front.

To put the events in context:Organics cost more.

  • Consumers spend about $30 billion on organics each year, and the numbers are rising.
  • Industrial food companies are cashing in on the market by buying up organic companies.
  • Big Organics want the rules to be as lenient as possible to all them to follow the letter of the organic standards without having to adhere to their spirit.
  • Organic production, which uses only approved pesticides and fertilizers, is an explicit critique of industrial food production methods.

The White House non-organic garden

I think this photo comes from Jerry Hagstrom who must have seen it on the day of the annual Easter egg roll.

Sam Kass denies that the White House garden is organic.  He told Hagstrom that “the sign was part of the Easter Egg Roll, not part of the kitchen garden…The planners of the Easter Egg Roll put up the sign…and he did not see it until he went down to the South Lawn during the event.”  The garden uses “organic practices.”

The “academic” attack on the integrity of organic certification

A report from something called Academic Reviews draws a conspiracy-theory picture of organic farmers:

Our review of the top 50 organic food marketers….reveals that anti-GMO and anti-pesticide advo­cacy groups promoting organic alternatives have combined annual budgets exceeding $2.5 billion annually and that organic industry funders are found among the major donors to these groups…These findings suggest a widespread organic and natural products industry pat­tern of research-informed and intentionally-deceptive marketing and advocacy related practices that have generated hundreds of billions in revenues.

Finally, the findings strongly suggest that this multi-decade public disinformation campaign has been conducted with the implied use and approval of the U.S. government endorsed USDA Organic Seal in direct contradiction to U.S. government stated policy for use of said seal….As a result, the American taxpayer funded national organic pro­gram is playing an ongoing role in misleading consumers into spending billions of dollars in organic purchasing decisions based on false and misleading health, safety and quality claims.

Michele Simon points out that the report is the work of the two founders of the publication, which is supported by an impressive list of food and biotechnology industry supporters.

The authors  make no statement about conflicts-of-interest.

What Americans really think about organics

Consumer Reports has a new survey of the attitudes toward organics of 1,016 adults.  The survey found:

  • 84% buy organic food and 45% but them at least once a month.
  • 81% think organic means no toxic pesticides (there are exemptions for some for up to five years).
  • 91% think organic produce should not use pesticides.
  • 61% think no antibiotics are used (there’s an exemption for streptomycin on apples and pears).
  • 86% think antibiotics should not be used.
  • 92% want a federal organic standard for fish.
  • 84% think the use of artificial ingredients in organic products should be discontinued, if not reviewed, after 5 years.

The fight between Big and Small Organics over the organic standards

The National Organic Standards Board (NOSB) is meeting in San Antonio this week.  Advocates for maintaining the highest possible standards for organic production are worried about the NOSB’s notice last September to eliminate the rule that synthetic materials approved for the organic production be reviewed every five years (see Federal Register).

Advocates for Small Organics worry that the NOSB’s actions will damage the credibility of the USDA organic seal.  Some members of Congress agree.

the Organic Consumers Association (OCA) and March Against Monsanto San Antonio (MAMSA) staged protested the sunset of the 5-year rule at the meeting.

Here’s a photo of the protest.  Things must have gotten hot and heavy.  The political director of the Organic Consumers Association was arrested.  The group issued this statement:

When the bureaucrats running the USDA National Organic Program (NOP) call in the police to remove the political director of the Organic Consumers Association for protesting an illegal policy change, and continue to ignore the expressed concerns, and block her from attending the public meeting today, it’s clear that we need a new balance of power between the organic community and the organic industry.

This is the price of success for organics.  Everyone wants to cash in.
