Europe food chair resigns industry post

This is a conflict-of-interest story.

Last week, FoodNavigator.com reported that the board of the European Food Safety Authority (EFSA) had reelected its chair, Diána Bánáti, despite evidence that she also sits on the board of the International Life Sciences Institute (ILSI), an industry-funded group that pretends to be a public health non-profit organization.

EFSA, you may recall,is the agency that is under enormous pressure to rule favorably on industry petitions to allow health claims on European package labels.

The EFSA board said:

The Board deplores the unfounded attacks on the independence of EFSA and its Chair recently reported, and concluded that by no means the integrity of the persons involved could be questioned.  However, the Board added that in order to avoid misperception, Bánáti should step down from management positions in any organisations that represent food industry interests, apart from public interests.  Professor Diána Bánáti has resigned from positions which may create a potential conflict of interests with EFSA activities.

ILSI was not one of the organizations from which she resigned.  Evidently, the EFSA Board considers ILSI to be a public health organization.

Within days, however,  Ms Bánáti thought better of it and resigned from the ILSI Board. To my great surprise, I get credit for this action.

Bánáti’s action was that recommended by Marion Nestle, an expert on nutrition and the food industry at New York University, in a Nature news article on the matter—Food agency denies conflict-of-interest claim—who said that were she Bánáti, “she would resign from the ILSI board”….In a statement issued yesterday, ILSI says that it “accepts Professor Diána Bánáti’s decision to resign from the ILSI Europe Board of Directors with regret” and reiterated its insistence that ILSI is not a lobbying group.

Nature is the most prestigious science magazine in Great Britain and, arguably, anywhere, but I thought I was simply stating the obvious.

British government promises no regulation in exchange for food industry funding

In a classic example of government sending the fox off to guard the chickens, Andrew Lansley, Britain’s new health minister has just handed the country’s food industry a gift it cannot refuse.  If the industry agrees to pay for the British government’s principal anti-obesity campaign, the government promises that it will impose no new regulations on the industry.

According to The Guardian (UK):

[Lansley] told a conference of public health experts that he wanted a new partnership with food and drink firms. In exchange for a “non-regulatory approach”, the private sector would put up cash to fund the Change4Life campaign to improve diets and boost levels of physical activity among young people…He said business people ‘understand the social responsibility of people having a better lifestyle and they don’t regard that as remotely inconsistent with their long-term commercial interest.”

I posted about the Change4Life program on January 24, 2009.  Even then, it was clear that the program was deeply influenced by food industry interests:

British government launched an anti-obesity campaign: The UK government’s Change4Life campaign is designed to promote healthier lifestyles.  This is causing much discussion, not least because of its food-industry sponsorship (uh oh).  Food companies are said to view the campaign as good for business (uh oh, indeed). The government wants everyone to help with the campaign by putting up posters and such, and its website is cheery.  Buried in all of this is some good advice, but most of it is phrased as eat better, not eat less or avoid.  That, of course, is why the food industry is willing to fund a campaign which, if successful, could hardly be in the food industry’s best interest.

I asked Tim Lang, Professor of Food Policy at City University, London, what this was all about (he wrote an editorial for the British Medical Journal, which I will post when it appears).

The speech by Andrew Lansley was pretty depressing. Not only did it forecast handing over funding of the sole national social marketing effort on obesity to companies, but it also heralds a return to the bad old days when the UK Government buried its head in the sand about food and public health issues. It’s taken 30 years to get first the Thatcher-Major Conservative Government (in the 1980s & 90s) and then the Blair-Brown Labour Government (in the 2000s) to see that government does have a role.

Indeed, without government setting the framework, there can be a race to the bottom: an avalanche of competing messages all appealing to individual behaviour change, when no individual can control the determinants of their health. That’s why so many people are troubled by Mr Lansley’s speech. It winds back that learning process over the last two decades, reducing health to individual choices and to market relationships.

Ironically, that might be its Achilles heel. As a strategy, corporate responsibility puts awesome responsibility on the companies to sort out public health, which they neither want to do (they sell products, not health!) nor are able to do, even if they wanted to. Not even the mightiest food companies control all the variables for health.

In that sense, Mr Lansley’s speech was dangerously policy illiterate. Advances in health come when the ground rules are changed; thereafter, let markets operate, fine. But to reduce public health to market dynamics flies in the face of history. But let’s see. Maybe this was sabre rattling. But maybe not.

Michele Simon, who alerted me to this story in the first place, asks: “What is the trade exactly?”  This is a complete “win-win for industry.  They get to run the campaign and not be regulated.”

Moral: Expect no public health messages about eating less, or further restrictions on health claims from this campaign.

Enough about Alaska. What about Gulf seafood?

A reader, Lucas Pattan, writes:

I’m writing to ask if you could do a post over the next few weeks about what you expect the impact of the Gulf spill will be on America’s seafood industry.  GQ has an amazing piece about fishermen and rigmen affected by the Deepwater Horizon, and the information about the fishing industry is pretty frightening [for the GQ piece click here].

I don’t have a crystal ball about the impact of the BP disaster on the Gulf seafood industry, but I’m assuming its effects will cause problems similar to those that happened as a result of the Exxon Valdez oil spill—only worse.

The Exxon Valdez spill occurred in 1989 in cold Alaskan waters.  Fish and wildlife stocks have not fully recovered 21 years later and it will be years before they do.  According to the Wikipedia entry on this event:

Both the long- and short-term effects of the oil spill have been studied comprehensively….The effects of the spill continued to be felt for many years afterwards. Overall reductions in population have been seen in various ocean animals, including stunted growth in pink salmon populations….Almost 20 years after the spill, a team of scientists at the University of North Carolina found that the effects are lasting far longer than expected. The team estimates some shoreline Arctic habitats may take up to 30 years to recover.

The Wikipedia continues with a comment on corporate responsibility:

Exxon Mobil denies any concerns over this, stating that they anticipated a remaining fraction that they assert will not cause any long-term ecological impacts, according to the conclusions of 350 peer-reviewed studies. However, a study from scientists from the NOAA concluded that this contamination can produce chronic low-level exposure, discourage subsistence where the contamination is heavy, and decrease the “wilderness character” of the area.

It looks to me as though the ecological, economic, and corporate effects of this one will be even worse and longer lasting:

  • It’s a bigger and longer lasting spill.
  • The economy of the Gulf states have yet to recover from hurricane Katrina.
  • Oysters don’t swim.
  • Much of the Gulf was already a dead zone created by agricultural runoff and industrial pollution.
  • The waters are warmer and less rich in nutrients.
  • U.S. energy policy still focuses on oil.

At the moment, is seafood from the Gulf region safe to eat?  President Obama says it is.  I hope he’s right

The FDA is sampling oysters, crabs, and shrimp and doing more inspection of seafood processing plants, closing down waters that seem to be contaminated, and doing what it can to make sure that tainted seafood is not getting into the marketplace.

According to a report in Food Chemical News II (June 21), the FDA says it will not re-open oil-contaminated waters to fishing until:

oil from the spill is no longer observable and seafood samples from the area successfully pass both sensory analysis by trained screeners and chemical analysis to ensure there are no harmful oil products found in them.

Smelling the fish to see if it’s OK?  I don’t think so.

Wild Alaskan seafood: sustainability

One point of the Alaskan Seafood Marketing Institute’s invitation to visit remote fishing and processing operations was to publicize the state’s fish sustainability initiatives (see Note below).

Everyone wants to catch fish.  But who has the right to catch them?  Fish swim long distances and pay little attention to political borders.  The commercial fishing industry is highly efficient at using technology to catch fish (the fish hardly have a chance).  And cultural issues are involved, as well as economic issues.  Indigenous communities have long standing cultural traditions related to fish.

Fish stocks are not infinite.   Hence, the need for management.

In Alaska, fisheries management is so complex that it takes a chart to explain how it works.  The goal is to have enough seafood available so all the stakeholders in the fish system can make a living.  Salmon, groundfish, halibut, and crab each require a different agency to manage stock conservation, set policy (local, national, and international) for who is entitled to fish, and enforce the rules.

For example, the Alaska Department of Fish and Game regulates the amounts of fish that can be taken, the Alaska Board of Fisheries decides who gets permits to fish, and Alaska Wildlife Troopers make sure everyone follows the rules.

The main management tools limit the time and place where fishing is allowed, and limit the number of commercial groups allowed to fish.  Alaskan fisheries are closed unless the Department of Fish and Game says they are open.   Nobody can fish in a closed area.

The number of fishing permits is fixed and finite, making them a market-driven commodity.  They are often handed down from generation to generation, but also can be sold.   A king salmon permit, for example, might cost as much as half a million dollars.  Yes, this allows rich commercial fishers to work in Alaskan waters.  But fishing area controls are democratic.  A closed fishing area is closed to rich and poor alike.

This system creates some tricky situations.  On the day we observed fishing in action near Sand Point, the area was open to salmon fishing. But it was closed to cod fishing.

The boat shown here was out salmon fishing.  It caught salmon, but also picked up an almost equal number of cod (we were told this was highly unusual).

The salmon would go to the cannery to be processed.  The best salmon would be processed with special care by Aleutia, an organization specializing in high quality Alaskan wild salmon getting high prices for fishermen.

The salmon were caught legally.  The cod, however, were by-catch.  They were not supposed to be caught in the salmon nets or, for that matter, at all that day.

What happened to the caught cod?  We ate one of them for dinner that night, prepared for us by Michael Cimarusti, chef owner of Providence (Los Angeles), who conveniently was a member of our group. It was worth the trip.

The others went for personal use or were thrown back into the sea to become food for crab or other seafood.  Under the rules, they could not be sold.

Does this complicated management system work?  It looked to me like it does the job pretty well.

  • Stocks of major Alaskan seafood—salmon, groundfish, halibut, and crab—are holding their own.
  • Everybody who fishes or depends on fish complains that they don’t get the chance to get enough of their fish.

Now, if only this system could go international, we might have a shot at keeping fish in the sea.

Food (un)safety update: E. coli 0145 in Arizona lettuce and more

It’s deja vu all over again with the recent recall of bagged romaine lettuce contaminated with a toxic form of E. coli.  The lettuce came from a central wash-and-bag facility that sent products out to food service companies in several states making about 30 people sick so far.

The one new development is the strain of E. coli: 0145, not O157:H7.  Despite decades of worry that other STECs (Shiga Toxin-producing strains of E. coli) cause serious human illness, state health departments don’t routinely test for 0145.  Clearly, they need to.

The FDA and CDC are both working on this case.

Meanwhile, the USDA issued compliance guidelines for reducing Salmonella and Campylobacter in poultry.  That’s nice, but what about STECs?

And the GAO has just issued a new report, FDA Could Strengthen Oversight of Imported Food by Improving Enforcement and Seeking Additional Authorities (don’t you love those titles?).  The report focuses on weaknesses in FDA’s oversight of food imports.

FoodQualityNews.com has a short but tough summary:

There are about 189,000 registered foreign sites where food is made for sale in the United States, according to the report. Of those, the FDA inspected just 153 in 2008…Meanwhile, the amount of food imported into the United States is increasing, and now accounts for 15 percent of the total food supply, including 60 percent of fresh fruits and vegetables and 80 percent of seafood.

What more evidence do we need for the urgency of passing food safety legislation?  Reminder: the Senate has been sitting on a food safety bill since the House passed it last August.  Apparently, this Congress this food safety can wait.  Tell that to the people who got sick from eating bagged romaine lettuce.

The latest survey: consumers want healthy foods!

Ordinarily, I don’t pay much attention to consumer surveys because the results are so dependent on the way the questions are asked and who gets polled.  But this one, conducted by StrategicOne and sent to me by Edelman Public Relations, is relatively uncomplicated.

It asks three questions (top responses, order of priority):

Which ONE of the following best describes the way in which you primarily think about food in your life? Health 23%, connection 18%, fuel 15%, love 12%,  pride 11%.

How important is it to you that each of the following food sources have specific initiatives focused on health, wellness and nutrition for people consuming their products? Supermarkets 91%, food producers 90%, packaged food companies 83%, casual dining restaurants 81%, fast food 68%.

How important is it to you that a food company have each of the following types of initiatives? Healthy foods that taste great 94%, health foods 92%, nutrition information 92%, community social responsibility 89%, front-of-package nutrition information 88%, fewer ingredients 75%.

People may not agree about they way they think about food, but it sounds like the respondents to this survey want the foods offered in supermarkets and restaurants to just take care of the health issues for them.  Good idea.

Food politics: our government at work (and play)

I’ve been collecting items sent to me this week about government actions at the local, state, and national level.  Here’s the weekend round up.

Santa Clara County, California, Board of Supervisors bans toys in kids meals: On April 27, the San Jose Mercury News announced that this county, clearly at the vanguard of actions to help prevent childhood obesity, passed a groundbreaking law banning toys in kids’ meals that do not meet minimal nutrition standards (the very ones I talked about in a previous post).  Companies can still give out toys in meals, as long as the meals meet those standards.  What an excellent idea.  Let’s hope this idea catches on in other communities.

Here’s the press release, a a fact sheet on childhood obesity, and remarks by the president of the board of supervisors, along with recommendations from the local public health agency.  Thanks to Michele Simon for the documents.

Connecticut state legislature plays computer games: This photo, attributed to the Associated Press, arrived from Michelle Futrell.  I worried that it might be Photoshopped.  Whether it is or not, it is flying around the Internet, in versions that clearly identify each of hard-at-play legislators.

The Federal Trade Commission (FTC) teaches kids about marketing: The FTC regulates advertising, including food advertising, and it must be getting increasingly concerned about the effects of marketing on kids.  To counter some of these effects, it has created a website, Admongo.gov, an interactive site to teach kids about advertising.  After playing these games, the FTC wants kids to be able to answer these questions:

  • Who is responsible for the ad?
  • What is the ad actually saying?
  • What does the ad want me to do?

The New York Times concludes: “Perhaps the effort comes not a moment too soon. Adweek devotes this week’s issue to “Kids” and “How the industry is striving to conquer this coveted market.” Thanks to Lisa Young for sending the links.

The FDA asks for comments on front-of-package (FOP) labeling: Patricia Kuntze, a consumer affairs advisor at the FDA sends the April 28 press release and the April 29 Federal Register notice announcing the FDA’s call for public comment on this topic.  The agency particularly wants data on:

  • The extent to which consumers notice, use, and understand FOP nutrition symbols or shelf tags
  • Results of research examining the effectiveness of various FOP approaches
  • Graphic design, marketing, and advertising that will help consumers understand nutrition information
  • The extent to which FOP labeling influences food manufacturers’ decisions about the contents of their products

The goal, says the FDA, is to make “calorie and nutrition information available to consumers in ways that will help them choose foods for more healthful diets – an effort that has taken on special importance, given the prevalence of obesity and diet-related diseases in the U.S. and of increasingly busy lifestyles that demand quick, nutritious food.”

Public comment, of course, includes the food industry and a FoodNavigator call for industry comment cites my recent commentary in JAMA with David Ludwig.  I’m glad food industry people are reading it and I hope the FDA does too.

The White House equivocates on organics: What’s going on with the White House garden?  Is it organic or not?   Michael Pollan forwards this item from the Associated Press:

Assistant White House Chef Sam Kass, an old friend of President Barack Obama’s who oversees the garden, says labeling the crops “organic” isn’t the point, even though the White House only uses natural, not synthetic, fertilizers and pesticides.

“To come out and say (organic) is the one and only way, which is how this would be interpreted, doesn’t make any sense,” Kass said Monday as he walked among the garden’s newly planted broccoli, rhubarb, carrots and spinach. “This is not about getting into all that. This is about kids.”

Uh oh.  Has “Organic” become the new O-word?  Surely, the White House is not secretly pouring herbicides and pesticides over its garden vegetables.  If not, are we hearing a small indication of big agribusiness pushback?

Genetically modified foods: good news, bad news

The National Research Council has a new study out evaluating the benefits of GM (Genetically Modified) foods: Impact of Genetically Engineered Crops on Farm Sustainability in the United States.  The blurb about the book gives the good and bad news (which is which depends on how you interpret it):

Since genetically engineered (GE) crops were introduced in 1996, their use in the United States has grown rapidly, accounting for 80-90 percent of soybean, corn, and cotton acreage in 2009. To date, crops with traits that provide resistance to some herbicides and to specific insect pests have benefited adopting farmers by reducing crop losses to insect damage, by increasing flexibility in time management, and by facilitating the use of more environmentally friendly pesticides and tillage practices.

But then it continues:

However, excessive reliance on a single technology combined with a lack of diverse farming practices could undermine the economic and environmental gains from these GE crops.

I haven’t had a chance to read the book yet but I most certainly will.  I am curious to know how the report defines “sustainability” in relation to GM food crops.  In the meantime, the New York Times has weighed in on some clearly unsustainable aspects of this technology:

Use of Roundup, or its generic equivalent, glyphosate, has skyrocketed to the point that weeds are rapidly becoming resistant to the chemical. That is rendering the technology less useful, requiring farmers to start using additional herbicides, some of them more toxic than glyphosate…Shares of Monsanto [the manufacturer of Roundup], which have been falling since January, slipped nearly 2 percent Tuesday to $67.75.

When the FDA first approved GM food crops for planting in 1994, critics warned that overuse of Roundup would eventually promote the growth and proliferation of plants resistant to this chemical.    Well, yes.

As for the scope of planting, we have Louis Umerlik to thank for creating these nifty maps of use of GM crops in the U.S.  Start with this one (it gives references to sources of the information).  Then look at his maps of soybean, corn, and cotton plantings.  Enjoy (or not).
