IOM releases tough report on front-of-package labeling

The Institute of Medicine (IOM) just released its second report on front-of-package (FOP) labeling.  It tells FDA to allow only four items in any front-of-package evaluation scheme:

  • Calories
  • Saturated and trans fat
  • Sodium
  • Sugars

To display this, the IOM committee recommends a point system based on levels of saturated and trans fats, sodium, and sugars for evaluating food products.  The points are to be indicated with check marks or stars.  Here is an example of how stars might be used to indicate products that qualify for zero, one, two, or three points.

I’m guessing that anything this clear and understandable will elicit storms of protest.

Recall that food companies have been setting their own nutrition criteria for evaluating their very own products and identifying the “better-for-you” or “more nutritious” products with special front-of-package logos.  By company standards, many of their products qualify for the logos.

To deal with the multiplicity and absurdity of such schemes, the FDA asked the IOM to take a look at the various FOP logos that were out there and recommend how to clean up the mess.  The first IOM report said the FDA should allow FOP labels to state only calories, saturated and trans fat, and sodium, but not sugars (this last was a mistake, I thought).

But—while the FDA was waiting for the IOM to produce its next report, the Grocery Manufacturers Association (GMA) and Food Marketing Institute (FMI) jumped the gun.  Their preemptive logo included “positive” nutrients such as vitamins and fiber along with the “negatives.”  This scheme is already in use on food packages.

The IOM committee was faced with an impossibly difficult task: to come up with a front-of-package scheme that would reduce the overall nutritional quality of processed foods to the sum of a few key factors.

Given strong industry marketing pressures to retain front-of-package labels—and the lack of an option to remove them altogether—the committee did the best it could with an inherently bad idea.

Why a bad idea?  FOP labels are a tool for selling, not buying.  They make highly processed foods look healthier, whether or not they really are.

And whether slightly better-for-you processed foods assessed by this method will help anyone to make better food choices and to be healthier remains open questions.

Nevertheless, the IOM proposal is a huge improvement over what food companies are now doing.  I consider it courageous.

Why courageous?  Because the scheme makes it so easy to distinguish products that qualify for the various point levels.

For example, here are some products that qualify for stars:

  • Toasted oat cereal
  • Oatmeal, instant
  • Milk, 1% fat
  • Yogurt, plain nonfat
  • Salad dressing, light
  • Orange juice, 100%
  • Grape juice, 100%
  • Kidney beans, canned
  • Peanut butter
  • Tomato soup, “healthy”
  • Tomatoes, canned

Examples of products that do not qualify:

  • Animal crackers
  • Graham crackers
  • Breakfast bar
  • Sweetened toasted oat cereal
  • Oatmeal, instant with fruit, nuts
  • Chocolate milk
  • Yogurt, sweetened

I can’t wait to see the GMA and FMI press release on this report.

And the FDA must now take this report under consideration to begin its interminable rulemaking process.

Why, you might ask, does any of this matter?  Aren’t questions about what food companies put on package labels basically trivial?  Don’t FOP label fights divert attention from other, more important food issues?

Maybe, but I see this as a test of the FDA’s authority to regulate and set limits on any kind of food industry behavior.  If the FDA cannot mandate a label that might help consumers choose healthier food options or refuse to permit labels that mislead consumers, it means the public has little recourse against any kind of corporate power.

I think this matters, and I’ll bet food companies do too.

And now, sit back and watch the lobbying begin!

That did not take long:  Here’s the GMA press release—fairly tame all things considered:

The Institute of Medicine’s Committee on Examination of Front-of-Package Nutrition Rating Systems and Symbols report adds a perspective to the national dialogue about front-of-pack nutrition labeling.  In the meantime, food and beverage companies have developed a real-world program that delivers real value to real consumers in real time.

Consumers have told us that they want simple and easy to use information and that they should be trusted to make decisions for themselves and their families. The most effective programs are those that consumers embrace, and consumers have said repeatedly that they want to make their own judgments, rather than have government tell them what they should and should not eat.  That is the guiding principle of Facts Up Front, and why we have concerns about the untested, interpretive approach suggested by the IOM committee.

My translation: Consumers prefer to have the food industry’s “Facts Up Front” tell them what to eat?  I don’t think so.

Help! Rescue the government’s marketing-to-kids nutrition standards!

I’ve just gotten an urgent plea from Margo Wootan at the Center for Science in the Public Interest (CSPI).

Please encourage everyone to write to President Obama, First Lady Michelle Obama, and federal agencies to support the nutrition standards for marketing foods to kids.

As I’ve discussed previously, these were created jointly by the Interagency Working Group (IWG) of four federal agencies—CDC, FDA, FTC, and USDA.

Under intense pressure from the food and entertainment industries and their friends in Congress, the IWG’s proposed guidelines—voluntary, no less—are in danger of being withdrawn.

Doing that might help corporate health but would do nothing for public health.

CSPI organized 75 researchers (including me) to send a letter to the President urging support of the voluntary guidelines and expressing dismay at the campaign of disinformation aimed at getting them withdrawn.

Junk-food advertisers, in the guise of the Sensible Food Policy Coalition, have attacked the voluntary guidelines as an assault on the First Amendment, a point debunked by top Constitutional experts, and claimed that adopting the voluntary guidelines would result in job losses, based on a flimsy industry “study.”

….It would be a real setback for children’s health if the Administration backed down on strong guidelines for food marketing to children, especially given the transparently specious arguments of junk-food advertisers….Denying the science on food marketing and childhood obesity is like denying the science on global warming or evolution.

But the food industry is dug in on this one.  For example, a reader sent me this letter from Tom Forsythe, Vice President, Corporate Communications, General Mills (excerpts follow with my comments in brackets):

Your email notes that we have lobbied against the Interagency Working Group (IWG) proposal.  That is correct.  We have serious concerns about the IWG proposal.

Our most advertised product is cereal – and we stand behind it.   Cereal is one of the healthiest breakfast choices you can make….If it is a General Mills cereal, it will also be a good or excellent source of whole grains.

Childhood obesity is a serious issue – and General Mills wants to be part of the solution.  But if the issue is obesity, cereal should perhaps be advertised more, not less.

…You can be assured than food and beverage companies have studied every letter, comma and period in the proposal.  We know what it says, and what it does not.

For example, we know that 88 of the 100 most commonly consumed foods and beverages could not be marketed under the IWG guidelines.  The list of “banned” items under the guidelines would include essentially all cereals, salads, whole wheat bread, yogurt, canned vegetables, and a host of other items universally recognized as healthy [Note: I’m not at all sure this is true–MN].

Despite the characterizations used to advance them, the IWG guidelines would not be voluntary, in our view.  The IWG guidelines are advanced by two of the agencies most responsible for regulating the food industry, as well as the agency most responsible for regulating advertising.  Ignoring their “voluntary guidance” would not be an option for most companies.

Regulation has already been threatened (even demanded) should companies choose not to comply – and litigation would inevitably follow.

The IWG guidelines also conflict with most existing government programs and definitions relative to food.  For example, many products that meet the U.S. Food and Drug Administration’s current definition of “healthy” could not be advertised under the IWG guidelines [It would be interesting to see examples].

Many products included in the U.S. Department of Agriculture’s Supplemental Nutrition Assistance Program fail the IWG standards, as do most products encouraged and subsidized under the USDA’s Women, Infants and Children Feeding Program (WIC) [If so, this is a sad commentary on what we encourage low-income mothers and children to eat].

Finally, your email suggests companies should focus on providing feedback via public comment.  We agree.  We have reviewed every detail of the IWG proposal – and we remain opposed, as our public comment explains.

My interpretation: if food companies are this upset, the guidelines must be pretty good.

Companies have the right to sell whatever they like.  But they should not have the right to market it as healthy or to kids.

Tell the IWG you support their guidelines.  Tell the White House to protect the guidelines.  Now, please.

My monthly (first Sunday) San Francisco Chronicle Food Matters column is on guess what?  This will be the last post on the new food icon for a while at least, I promise.

Q: What’s the big deal over the government’s new food icon? A plate? That seems really boring.

A: The Department of Agriculture’s plate may look banal, but it is a key part of first lady Michelle Obama’s healthy eating campaign and I see it as a big step forward. Unlike the 2005 MyPyramid, this one is mostly about food, is easy to understand, and does not require use of a computer.

The plate does a better job of reflecting current thinking about healthy diets than previous guides. Its four sectors are unequal. Vegetables get the most space, and dairy – a discretionary choice – is off to the side.

You are to pile half your plate with fruit and vegetables, and a quarter with grains (half of them whole grains). All these come from plants.

I’m less happy about the sector marked “protein.” Protein is not a food. It is a nutrient.

USDA must think everyone knows that “protein” means beans, poultry and fish, as well as meat. But grains and dairy, each with its own sector, are also important protein sources. The meat industry wants you to equate protein with meat. It should be happy with this guide.

What I like best are the messages that come with the plate. My favorite? “Enjoy your food, but eat less.”

At last! Enjoyment is part of dietary advice. High marks to USDA for this one.

Other messages are designed to help you eat less while eating better. Smaller portions keep calories under control. Making half your plate fruits and vegetables is a profound switch from the six to 11 calorie-rich grain servings you were supposed to eat daily under the old MyPyramid.

For people who drink milk (really, you don’t have to), switching to low-fat is an effective way to save on calories, and whole grains are better for health than refined, rapidly absorbable starches that behave like sugars in the body.

So far, so good. But next come the politically charged “foods to reduce.” Here, the USDA is leaning in the right direction, but still pulling punches. USDA tells you to reduce sodium from soup, bread and frozen meals, but says nothing about salty snacks or other sodium-laden processed foods. This is a glaring omission.

And the final principle – “drink water instead of sugary drinks” – puts naturally sweet fruit juices (fine in small amounts) in the same category as sugar-added juice drinks, sports drinks and sodas, which ought to be reserved for occasional treats.

Let’s give USDA credit for going as far as it could without directly confronting the processed-food and soft-drink industries.

Optimist that I am, I think the icon has plenty for everyone to work with. It emphasizes the positives – fruits, vegetables, whole grains – and leaves lots of room for enjoyment. You can pile whatever foods you like on that plate as long as they fit within their assigned sectors.

Best of all, you do not have to count numbers of servings. If you want to control the size of your servings, just use a smaller plate.

Consider the alternatives. From 1958 until 1979, the USDA’s uncontroversial Four Food Groups advised eating two or three servings a day from dairy, meat, fruits and vegetables, and breads and cereals – half the plate from animal-source foods.

In 1979, in an effort to help reduce dietary risks for chronic diseases, USDA stacked the groups with plant foods above animal foods, eliciting a furor that led USDA nutritionists to begin a 12-year project to research a new food guide.

USDA released a food guide Pyramid in 1991, withdrew it under protest from meat producers, and re-released it a year later. Meat and dairy producers did not like being at the “eat less” top of the Pyramid. Nutritionists thought it promoted too many servings of high-calorie grains.

In 2005, the USDA replaced that Pyramid with the unobjectionable, food-free MyPyramid. This was impossible to teach (you had to know what each color stood for), eliminated any sense that it is better to eat some foods than others, and required a computer to personalize your own diet.

USDA officials say they spent about $2 million to research and test the new plate logo, create its website, and publicize it. This is a lot or a little depending on your perspective, but a plate is not exactly a new concept. The American Diabetes Association, American Institute for Cancer Research and Canadian government have all used similar plant-focused plates for years. The Physicians Committee for Responsible Medicine has one with a similar design but 100 percent vegetarian.

We can argue over nutritional details, but I think USDA’s plate-plus-messages works better than anything it has done before. The plate works for health and for disease prevention. It took courage to make half of it fruit and vegetables. That’s real progress.

Now the challenge is to Congress: How about fixing agricultural policies so they support these recommendations?

MyPyramid R.I.P.

On May 26, the USDA announced that it will be releasing a new “food icon” to replace the foodless and useless 2005 MyPyramid:

 

The USDA’s press announcement explained:

The 2010 White House Child Obesity Task Force called for simple, actionable advice to equip consumers with information to help them make healthy food choices. As a result, USDA will be introducing the new food icon to replace the MyPyramid image as the government’s primary food group symbol. It will be an easy-to-understand visual cue to help consumers adopt healthy eating habits consistent with the 2010 Dietary Guidelines for Americans.

What will the new icon look like?  The USDA isn’t saying, but William Neuman of the New York Times did some sleuthing.  According to his account:

The circular plate, which will be unveiled Thursday, is meant to give consumers a fast, easily grasped reminder of the basics of a healthy diet. It consists of four colored sections, for fruits, vegetables, grains and protein, according to several people who have been briefed on the change. Beside the plate is a smaller circle for dairy, suggesting a glass of low-fat milk or perhaps a yogurt cup.

And WebMD scored an interview with Robert C. Post, PhD, deputy director of the USDA Center for Nutrition Policy and Promotion, who gave additional hints:

“There will be a ‘how-to’ that will resonate with individuals. That is the behavioral part that is needed. We need to transcend information — ‘here’s what the science says’ — and give people the tools and the opportunities to take action.”

He referred to six how-to messages to guide healthy eating that were released with the 2010 Dietary Guidelines, and which I enthusiastically posted when the Guidelines were released (I was disappointed that they weren’t actually part of the Guidelines):

• Enjoy your food, but eat less.

• Avoid oversized portions.

Foods to Increase

• Make half your plate fruits and vegetables.

• Switch to fat-free or low-fat (1%) milk.

Foods to Reduce

• Compare sodium in foods like soup, bread, and frozen meals—and choose the foods with lower numbers.

• Drink water instead of sugary drinks.

A bit of history:

From 1958 until 1979, the USDA’s food guide was sort of a rectangle illustrating four food groups: Dairy, meat, fruits and vegetables, breads and cereals.  In 1979, USDA introduced a highly controversial design with food groups stacked on top of each other, with the plant-food groups at the top and the animal-food groups underneath (the producers of these foods did not like that).

Beginning in 1980, the USDA conducted an extensive research project to develop a new design—the pyramid—which it released in 1991 and withdrew immediately under pressure from meat producers.

In 1992, after a year of extraordinary controversy (recounted in my book Food Politics), the USDA released its highly controversial Food Guide Pyramid.

 

Why was it controversial?  The food industry objected that the Pyramid make it look as if you were supposed to eat more foods from the bottom of the pyramid than the top (which, of course, was its point).

Nutritionists objected that it encouraged eating too many servings of grains and, therefore, encouraged obesity.

In 2005, the USDA replaced it with the unobjectionable MyPyramid.  The food industry liked this one because it did not indicate hierarchies in food choices.  Most nutritionists that I know hardly knew what to do with it.  It required going online and playing with a website, and was unteachable in clinic settings.

I thought the 1992 pyramid had a lot going for it, particularly the idea that it’s better to eat some foods than others.  But MyPyramid was a travesty–hopelessly complicated, impossible to teach, and requiring the use of a computer.

Given this situation, the new image is highly likely to be an improvement.  If the new icon keeps the hierarchy, conveys concepts easily, and does not require online access, I will consider it a great step forward.

At last FTC releases principles of food marketing to kids

The FTC released its long-awaited principles for food marketing to children today.  These are proposed principles, scheduled to apply to marketing to children age 2 to 17, to go into effect by 2016.  The principles are now open for comment.

Principle A: Foods marketed to children must make a meaningful contribution to healthful diets, and contain at least one of these food groups:
• fruit
• vegetable
• whole grain
• fat-free or low-fat (1%) milk products
• fish
• extra lean meat or poultry
• eggs
• nuts and seeds
• beans
Principle B is that the foods should minimize intake of nutrients that could have a negative impact on health or weight.  The key standards are:
• Saturated Fat: 1 g or less per serving and 15% or less of calories
• Trans Fat: 0 g per serving
• Added Sugars: No more than 13 g of added sugars per serving
• Sodium: No more than 210 mg per serving
I thought the original proposals were far too generous.  But the only difference between these proposals and those proposed a year or so ago is a slight increase in sodium from 200 mg to 210 per serving.  I can only assume that this  difference is just enough to include a lot of junk foods that would otherwise be excluded by these principles.

 

Recall the history:  In 2009, Congress specified that an interagency group was to set up standards for identifying foods that should not be marketed to children and to publish them by July 15, 2010.   That group came up with a set of recommendations similar to these but more complicated.

The July 15 date came and went, as I explained in a previous post.  Why?  Rumors were that food industry opposition got in the way.  As reporter Melanie Warner pointed out, weak as they may appear, the proposed standards would exclude a great many highly profitable food products.  William Neuman provided a detailed account of why the FTC wasn’t budging on this in the New York Times.  And the Colbert Report had some fun with the FTC’s delay.The food industry has consistently opposed giving the FTC more authority over marketing of foods and supplements.

 

What are we to make of this? In the light of this history, the FTC must be congratulated for its courage in overcoming food industry opposition.  The principles are supposed to apply to all forms of media, print and electronic.  If so, the food industry will have a much harder time marketing foods to kids.  That’s great news.

But here’s what I’m still concerned about:
  • The principles are voluntary. Nobody has to follow them.
  • Who is going to hold food companies accountable for following the guidelines?
  • Why do food companies get until 2016 to implement them?  Five years?
Can’t we do any better?  Of course, given my druthers, food companies would not be allowed to market directly to children at all.


Update, April 29: According to Advertising Age, the food and advertising industries are unhappy with the FTC proposals:
If companies were to comply with these proposals, the restrictions are sufficiently onerous that they would basically block a substantial amount of advertising.

Food marketing to kids goes viral

Several recent articles highlight concerns about food marketing to children.  Yesterday’s New York Times, for example, explained why obesity experts are increasingly concerned about advertising through new electronic media:

Like many marketers, General Mills and other food companies are rewriting the rules for reaching children in the Internet age. These companies, often selling sugar cereals and junk food, are using multimedia games, online quizzes and cellphone apps to build deep ties with young consumers. And children…are sharing their messages through e-mail and social networks, effectively acting as marketers.

…The sites can attract substantial audiences. HappyMeal.com and McWorld.com, sites from McDonald’s, received a total of 700,000 visitors in February, around half of whom were under 12, according to comScore, a market research firm. The firm says 549,000 people visited the Apple Jacks site from Kellogg’s, which offers games and promotes an iPhone application called “Race to the Bowl Rally.” General Mills’s Lucky Charms site, with virtual adventures starring Lucky the Leprechaun, had 227,000 visitors in February.

Advertising Age notes the use of cell phones, ipods, and ipads by younger and younger children:

Over half the parents in the survey say their children should be able to go online on their own by age 6, and by 5 should be able to play games on a cellphone or on a console or listen to a portable music player on their own.

And the Public Health Law Network explains takes up the question of parental responsibility vs. food industry responsibility.  It asks whether it is:

reasonable for food and beverage companies to spend hundreds of millions of dollars targeting children with marketing, mostly for obesogenic foods, placed literally everywhere and anywhere a child might eat, study, or play, and then demand that parents run interference against them?

Food companies think marketing to kids is plenty reasonable.

Here’s a situation in which some policy changes would be most helpful.  How about some restrictions on what food companies can do in order to make it easier for parents to manage what their kids eat?

Once again, kids prefer foods in packages with cartoons

Yet another study confirms the obvious: kids prefer foods with cartoons on the package. Why should this be obvious?  Why else would the cartoons be there if not to sell products to kids?

The latest study comes from the Archives of Pediatrics and Adolescent Medicine.

It says pretty much the same thing as the study published in Pediatrics last year by investigators from the Yale Rudd Center.

The newer study did something cute. It invented a cereal box and tested kids’ responses to it and variations with and without cartoons of the penguins Mumble and Gloria from the movie Happy Feet .


The results:

  • Kids preferred the taste of the cereals with cartoons
  • They preferred boxes labeled “Healthy Bits” more than “Sugar Bits”
  • They most preferred “Healthy Bits” with a cartoon
  • They least preferred “Sugar Bits” without a cartoon

This is why is would be a good idea to just say no to cartoons on food packages aimed at kids.

American Heart Association says “I ♥ beef”!

The Beef Board, the USDA-managed checkoff program for marketing beef, proudly announces its new partnership with the American Heart Association (AHA).  The Beef Board gets its money from a compulsory tax on cattle ranchers computed every time they sell an animal.  Evidently, the money is well spent.

The AHA will put its HeartCheck symbol on three cuts of lean beef:

  • Boneless Top Sirloin Petite Roast (select grade)
  • Top Sirloin Filet (select grade)
  • Top Sirloin Kabob (select grade)

A member of the Beef Board says: “”We are extremely thrilled to receive the American Heart Association certification because, for consumers, it represents the independent voice of a trusted health organization.”

I’ll bet they are.

Today’s quiz: How much money is the Beef Board paying the AHA to use its CheckMark logo?

I hope it’s a lot more than what the AHA gets (or used to get) for putting its check mark on sugary cereals.  This was $4,500 per product when I updated Food Politics in 2007.  After all, sugary cereals don’t have any saturated fat or cholesterol so they must be heart healthy, no?

Ah partnerships and alliances.  You have to love them.  How will the Beef Board use the HeartCheck?  With an I ♥ Beef  campaign, of course.  Fat content unspecified.
